Certain provisions of the Historic Environment (Wales) Act 2016 (the 2016 Act) require the electronic publication of the particulars of any notices served.

Scheduled monument enforcement notices

Section 12 of the 2016 Act gives the Welsh Ministers powers to issue a scheduled monument enforcement notice to halt unauthorised works to a scheduled monument and order operations to repair or alleviate the resulting damage. The Act also requires the electronic publication of particulars relating to an enforcement notice.

Scheduled monument consultation notices

The 2016 Act places a requirement for the Welsh Ministers to consult with owners, occupiers and other persons if they are proposing to schedule a monument, make a material amendment to a scheduled area or remove a monument from the schedule. Particulars of every consultation notice must be published electronically.

Interim protection — scheduled monuments

A monument being considered for scheduling or a proposed addition to a scheduled area will enjoy interim protection as if already scheduled under the Ancient Monuments and Archaeological Areas Act 1979. Interim protection will last from the beginning of the consultation period until the Welsh Ministers reach a decision on the designation.

Interim protection — listed buildings


A building being considered for listing will enjoy interim protection as if already listed under the Planning (Listed Buildings and Conservation Areas) Act 1990. Interim protection will last from the beginning of the consultation period until the Welsh Ministers reach a decision on the designation.
