Statutory scheduled monument consultation notices

In this guide

1. Consultation notices

Scheduled monument consultation notices

The Historic Environment (Wales) Act 2023 places a requirement for the Welsh Ministers to consult with owners, occupiers and other persons if they are proposing to schedule a monument, make a material amendment to a scheduled area or remove a monument from the schedule. Particulars of every consultation notice must be published electronically.

Interim protection — scheduled monuments

A monument being considered for scheduling or a proposed addition to a scheduled area will enjoy interim protection as if already scheduled. Interim protection will last from the beginning of the consultation period until the Welsh Ministers reach a decision on the designation.

2. Enforcement notices

Section 35 of the 2023 Historic Environment (Wales) Act gives the Welsh Ministers powers to issue a scheduled monument enforcement notice to halt unauthorised works to a scheduled monument and order operations to repair or alleviate the resulting damage. The Act also requires the electronic publication of particulars relating to an enforcement notice.
